Judge tells wife of Pak man to submit his docs

Mumbai: The Bombay high court on Tuesday directed the Sajida Khan wife of Siraj Khan, who had ventured into India from Pakistan at his childhood and has now been deported to Pakistan, to amend her petition and include documents like her husband’s application for citizenship of India that is not yet decided. Ms Sajida has approached the high court seeking to quash deportation order of her husband.

Ms Sajida and her three minor children have filed this petition praying the court to direct the Central government to take steps to bring Mr Siraj back to India for his stay with petitioners till his application dated May 26, 2014 for grant of Indian citizenship is decided and in the event of an adverse order, further suitable time be granted to challenge the validity of such order.

The family has also requested the court to declare his arrest by police under clause 11 (2) of the foreigner’s order, 1948, as illegal, null and void with permission to Mr Siraj to do his job as he has been doing prior to his arrest.

Ms Sajida has alleged that the police have registered a case of illegally staying in India against her husband and they were told that police is taking him into custody in relation to that case, however, later they came to know that he was arrested under foreigners order and surreptitiously deported to Pakistan.

It may be recalled that as per Mr Siraj’s own story he ran away from his house because he was fed up of family forcing him to go to school everyday. He took a train which brought him to Attari from there he entered into India by mistake at the age of 10. He was first caught in Ahmedabad and was kept in juvenile home. After his release he came to Mumbai and got married to Ms Sajida in March 2005. Later he applied for citizenship of India and was caught by police.
