Supreme Court refuses to grant bail to cancer patient

As per the medical report the accused Aasu Jaif was being given proper treatment that could be given in the circumstances.

New Delhi: The Supreme Court on Thursday refused the plea for bail by an oral cancer (Buccal Mucosa) patient who sought to be released so that he could go for a better treatment of his ailment which was affecting his physical condition. Jaif had contended that he was undergoing radiotherapy every day and due to its effect and that of other treatments he was suffering from insomnia, and his inability to take solid food was resulting in loss of weight. The vacation bench of Justice Indira Banerjee and Justce Ajay Rastogi declined the plea after examining the medical report submitted by the Birla Cancer Centre/Department, Sawai Man Singh Hospital, which was placed before the bench.

Jaif is being treated at Birla Cancer Centre/Department, Sawai Man Singh Hospital, and the court in the last hearing of the matter had sought report from it. However the court permitted the petition to be withdrawn and was dismissed as withdrawn.

As per the medical report the accused Aasu Jaif was being given proper treatment that could be given in the circumstances.

Jaif is in incarceration for last eight months for possessing counterfeit currency

Jaif had told the court that he was diagnosed with oral cancer while in jail and because of the lack of proper treatment his cancer has advanced from stage II to stage III.

As the lawyer for Zaif contended that the mastermind of the  counterfeit currency Deepak Kumar Meena and its accomplice  Sunil Kumar Meena have already been granted bail, Justice Rastogi observed that Jaif has sought bail on medical grounds only.

The top court had on May 28 sought response from Rajasthan government on Jaif’s plea for release contending that he is suffering from stage III oral cancer and was not getting appropriate treatment in jail.   

Jaif lodged in Jaipur Central Jail had challenged Rajasthan High Court order rejecting his plea for bail.

Jaif has been charged for possessing counterfeit  currency and is booked under  Section 489-A, B, C and D and Section 511 of IPC and is in jail for last eight months.
