Disappointed, lost faith in system: Varnika after stalkers refuse blood, urine tests

Chandigarh: The family of 29-year-old Chandigarh woman Varnika Kundu, who was stalked and harassed by Haryana BJP president's son and his friend, said they were disappointed and may review their case after it emerged that the police may not have forced the suspects to undergo a medical examination that could have strengthened the case. 

The medical reports showed Vikas Barala, the son of Subhash Barala, and his friend Ashish Kumar refused to give their blood and urine samples after their arrest.

The new exposure could potentially put more pressure on Chandigarh Police, battling allegations of diluting the case against the son of an influential leader of the ruling party. 

Talking to Hindustan Times, Varnika Kundu asked, "If someone, who constantly chose to keep faith in the system, is also dealt with like this then what good is such a system?"

“I’m very disappointed. This is definitely going to change things,” she added.

Varnika, a DJ, also said she does not to interfere with the investigation but her trust had been broken and that she might want to review the process now. Her father, IAS officer VS Kundu, was equally surprised at the development said he was “angry”.

“Can they even do this? Can they refuse?” he asked. “I was told by the police that they were taken to GMCH-16 for the medical exam from the police station in Sector 26 so I don’t know what exactly to say,” the father added.

“Their breath smelled of alcohol and their eyes were red (congestion of the conjunctiva) and both denied to give blood and urine samples to testify the blood alcohol content,” the report that was based on observation and prepared by doctors of the civil hospital at Manimanjra in Chandigarh said.

Earlier on Wednesday, Tajender Singh Luthra, Director General of Police (DGP) said both the accused in the Chandigarh stalking case had refused to give their blood and urine sample for the investigation.

A summon-notice was also issued to Vikas by the Chandigarh Police which was allegedly refused by the former.

The Chandigarh Police asked Vikas to appear before the Station House Officer (SHO) of Sector-26 Police Station at 11 am 'sharp' on Wednesday.

The notice been issued under 160 Code of Criminal Procedure (CrPC) and the case has been filed against Barala under Section 354D (stalking), 341 (wrongful restraint), 34 (common intention) of the Indian Penal Code (IPC) and 185 MV Act (rash driving).

Vikas Barala was arrested on August 5 on the charges of stalking and harassing the IAS officer's daughter Varnika Kundu in Chandigarh. He was, however, granted bail on the same day.

A case was registered by the Chandigarh Police against Vikas and other youth under under Section 354 D (stalking) of the Indian Penal Code and Section 185 (Motor Vehicle Act) of the CRPC on the basis of complaint filed by the woman.
