Apex court seeks amicus curiae's help on EC protection

The petitioner submitted that the CEC and ECs enjoy the same decision-making powers.

New Delhi: The Supreme Court on Friday sought the assistance of senior advocate Meenakshi Arora, representing the Election Commission in deciding a PIL for a direction to the Centre to amend the Constitution to grant protection to the two Election Commissioners from arbitrary removal.

A three-judge bench of Chief Justice Dipak Misra and Justices A.M. Kanwilkar and D.Y. Chandrachud passed this order on a writ petition filed by advocate and BJP leader Ashwini Kumar Upadhyaya.

Counsel Gopal Sankaranarayanan, appearing for the petitioner pointed out that ECs shall not be removed except on the recommendations of the CEC. It was in this context the court sought Ms Arora’s assistance.

The petitioner submitted that the CEC and ECs enjoy the same decision-making powers.
