Aadhaar case to determine future of nation: Sibal

He said ADM Jabalpur was a limited regime, whereas Aadhaar is unlimited.

New Delhi: Senior Congress leader Kapil Sibal on Tuesday urged the Supreme Court to strike down the Aadhaar law as unconstitutional, pointing out that this was the most important case since Independence.

Summing up his arguments before a Constitution bench of Chief justice Dipak Misra and Justices A.K. Sikri, A.M. Kanwilkar, D.Y. Chandrachud and Ashok Bhushan, the senior counsel said that the present case was more important than ADM Jabalpur case during the Emergency, when the apex court upheld suspension of fundamental rights. He said ADM Jabalpur was a limited regime, whereas Aadhaar is unlimited.

Mr Sibal said, “This judgment will decide the course that this country takes. Will we live in a country where there is choice, or do we live in a country where the State is the arbiter of choice.”
