'Nyas created to oust Akhara in temple dispute'
Dhavan said that Ram Janmasthan could not have been a Swayambhu as every Swayambhu has process and time attached to it on its coming into being.
New Delhi: The Supreme Court on Monday was told that Ram Janmabhoomi Nyas — which included people from Vishwa Hindu Parishad and RSS — was created in 1985 with the sole objective to oust Nirmohi Akhara and use the arguments of faith and belief to build a new temple at Ayodhya under its control.
Sunni Waqf Board said this to the-five constitution bench headed by the Chief Justice Ranjan Gogoi citing the pleading by the Narmohi Akhara before the Allahabad High Court.
Taking the bench, also comprising Justice S.A. Bobde, Justice D.Y. Chandrachud, Justice Ashok Bhushan and Justice S. Abdul Nazeer, thorough the composition of Nyas, senior counsel Rajeev Dhavan said that two of its members were VHP leaders — Vishnu Hari Dalmia and Ashok Singhal — since both dead and a RSS member.
He said that creating a distinction between the idols of Ram Lalla and attributing Swayambhu to Ram Janmasthan was an attempt by Nyas to take it out of the challenge from other parties to dispute and also tell the court that it was beyond its jurisdiction.
Dhavan said that Ram Janmasthan could not have been a Swayambhu as every Swayambhu has process and time attached to it on its coming into being and a definite manifestation of nature attached to it like holy place of Kedarnath and Amarnath or other tirathsthan of Hindu religion.
