Delhi high court denies bail to gold merchant
The complainant, a cost accountant, had entrusted the gold, his ancestral property, to the accused, Prakash Gupta, in 2016 for selling.
New Delhi: The Delhi high court refused to grant anticipatory bail to a gold merchant for allegedly misappropriating 33 gold bars weighing six kg. The complainant, a cost accountant, had entrusted the gold, his ancestral property, to the accused, Prakash Gupta, in 2016 for selling. First, the accused told the complainant that he would make payment of Rs 1.88 crore, through cheque as per the desire of the seller. Later, he said that the buyer had made the payment in cash, and he was on the way with it. Finally, the accused told him that he had been robbed of the cash.
On inquiry the complainant found that the accused had concocted the story of being robbed, and filed a complaint in the lower court.''The petitioner has committed criminal breach of trust by misappropriating the valuable property of the complainant. The custodial interrogation is required to unearth the conspiracy and to recover the gold bars or the sale proceeds thereof and to find out to whom the gold bars were sold to,” the court ordered.
