Mumbai: Bail granted to alleged bomb maker

The court granted him bail relying on the forensic report that the material used in the bomb were used in and the incident happened during Diwali.

Mumbai: A sessions court has granted bail to a resident of West Bengal arrested for allegedly attempting to make a bomb. The arrest was made after a small blast at Antop Hill last year.

The court granted him bail relying on the forensic report that the material used in the bomb were used in and the incident happened during Diwali.

The court also noted that no motive had been mentioned in the charge sheet and he did not have criminal antecedents.  Advocate Adil Khatri said that the court had granted bail to his client Ejarul Kased Shaikh (24) on furnishing cash of '15,000.  

Shaikh was arrested in October 2018, after the Antop Hill police received information that the applicant in the vicinity of Nura Bazar, Bangalipura had exploded a handmade bomb.

Later, the case was transferred to the Mumbai crime branch Unit four.  

The prosecution had opposed the bail plea saying that the accused could pose danger to the security of India and that the National Investigation Agency (NIA) was also checking if he had any links with terror groups.  A.H. Laddhad while granting bail to Shaikh observed that,

“After filing of the charge sheet, the prosecution did not come up with the case that the applicant is having any nexus with any anti-social elements and also failed to bring any material to show that the applicant was planning for any illegal act against the security of the nation.”  

The Judge agreed with advocate Khatri’s contentions that the applicant was entitled for bail. The Judge noted, “The material which was found, it is mentioned in the FSL report that may be used for preparing crackers. The alleged incident occurred during the period of Diwali.”

According to the bail order, during the probe the investigating officer recorded Shaikh’s confessional memorandum and he had showed the place from where he had bought the crackers and other articles.

“Looking to the age of the applicant, there are no criminal antecedents against him, no particular motive is brought on record, I do not find any material to keep him behind bars till the time trial would conclude,” observed the Judge while granting him bail.
