DSK's plea for quashing of FIRs rejected

The bench upheld the contentions of the state and rejected the plea and placed the matter for hearing on January 10, 2018.

Mumbai: The Bombay high court has rejected the plea of DSK developer to quash the FIRs registered against them in various cities in the state and also restrain the police from taking any harsh action on them. The court accepted the contentions of the state that as there were numerous FIRs registered against the developer for not returning the amounts deposited with them by investors, the plea should not be allowed. In another case, the high court has given the developer up to Monday to give an undertaking as to when and how much money they are going to pay back the investors.

A division bench of justices Ranjit More and Dr Shalini Phansalkar Joshi was hearing the criminal writ petition filed by Deepak Sakharam Kulkarni also known as DSK, seeking directions to the police from taking any coercive action against them in light of various complaints lodged against them in different police stations. The plea sought interim relief and quashing of the FIR’s too. Following the complaint lodged against DSK on October 28 in Pune, hundreds of investors out of the nearly 4,000 have lodged complaints in other cities too. The real estate developer has been accused of cheating and duping investors to the tune of '450 crore.    

The chief public prosecutor for the state opposed the plea stating that a case was registered against DSK under the Indian Penal Code (IPC) as well as Maharashtra Protection of Interest of Depositors (MPID) Act and as the police was investigating more than 425 complaints against the developer, the plea should be rejected.
