POCSO court lets off 2 blamed for raping minor

Mumbai: A special Protection of Children from Sexual Offences (POCSO) court has acquitted two men of the charge of raping a minor after the DNA report didn’t match with any of the accused. Incidentally, when the family of the victim, who during the trial delivered a baby, found the girl pregnant she told them that one Hemant had raped her a month back.

However, medical reports showed that she was 23-weeks pregnant. The girl then told the police that her pregnancy was the result of her relationship with one Irfan, but the Deoxyribonucleic acid (DNA) report was negative so the court acquitted both of them.

According to accused Hemant Reddy’s defence lawyer Prakash Salsingekar the DNA report of the child did not match with the accused and hence special POCSO judge Madhuri More acquitted his client.

The complainant had put forth two stories of her rape following which the Cuffe Parade police had booked two persons living in her vicinity. The complaint was lodged in November 2014 when the family of the victim noticed that she was pregnant. When they asked her about her pregnancy she claimed that the 38-year-old Reddy, a driver by profession, living in the same area had raped her in August 2014.

She claimed that Reddy had threatened her that he would fake a story about their affair and would earn her a bad name. He had then taken her to the flat of his employee when nobody was present there and had raped her.

However, when the victim was sent for medical report it was found that she was pregnant prior to the said incident and hence she again told the police that she was in love affair with one of her friend’s brother Irfan Hussain and to save Irfan she didn’t take his name.

According to advocate Salsingekar apart from negative DNA report there were other discrepancies in her statements and hence the judge acquitted both the persons.
