Court denies bail to delivery boy held for molestation
The accused, who was riding a bike, was nabbed on the spot as he lost balance and fell from the motorcycle.
Mumbai: A sessions court in Dindoshi has the rejected bail application of a delivery boy arrested for molesting an unknown female pedestrian.
The accused, Vishal Patel, who was riding a bike was nabbed on the spot as he lost balance and fell from his motorcycle in an attempt to flee.
Patel had filed the plea on the ground that he was falsely implicated and chargesheeted in the case and there was no need to keep him in custody any more.
On the other hand, public prosecutor Usha Jadhav opposed his bail application. She said that the crime was serious in nature and he was caught because he fell from the bike after the incident. Also, there were similar cases registered against him, she claimed.
After hearing arguments, sessions judge S.U. Baghele observed, “The courts of law cannot be the mute spectators to the happenings in the society, more particularly, in relation the occurrence of a serious crime against women. The perpetrators thereof are required to be dealt with, with stern hands.” He added, “The applicant, prima facie, appears to be a menace to society, more particularly to every woman. Setting him at large is certainly letting the menace in the society, thereby keeping the modesty of every woman at stake (sic).”
The judge also took note of the fact that as per the police, the accused was allegedly involved in another similar crime, which “shows that he adopts a similar modus operandi to outrage the modesty of women”.
“In above circumstances, the applicant is not entitled to be enlarged on bail,” observed the judge while rejecting his bail application.
