Insurance firm instructed to pay Rs 1crore to deceased's family

Mumbai: Motor accident claims tribunal of Mumbai has directed an insurance company to pay Rs 1.10 crore as compensation to family members of the deceased, who died in an accident.
According to the application dated on June 7, 2012 , the deceased Sugandh Talawadekar was travelling from Mumbai to Pune in a vehicle hired by his company from the owner Prabhanjan Tawade. His vehicle met with an accident on Mumbai-Pune ex-press highway and Talawadekar died on the spot. The tribunal while passing order referred FIR and witness statements.
Talawadekar who worked as deputy manager in Parksons packaging limited company at Lalbaugh, was going to Pune for official work when he met with an accident. He survived by his wife, two daughters, his mother and father and was the sole earning member.
Insurance company had denied giving claims made by the vehicle owner Tawade, saying he had broke all terms and conditions of the contract and gave the car on rental basis to the Talawadekar’s company. They also brought to the tribunal’s notice that the driver who was driving the car didn’t have driving license.
However, the tribunal refused to believe the company’s arguments on the basis of evidence and statement of witnesses and directed the company to pay compensation to the deceased’s family.
