Builder sells unauthorised flats, yet to be arrested

However, in 2012, the construction stopped, and despite demanding a refund, the builder refused to do so.

Mumbai: The police is yet to arrest Yogesh Jadhav, a builder from the BBJ Group of Construction, for cheating an Andheri-based complainant by selling him a flat in a developing project at Vikhroli where construction was unauthorised.

The complainant, Hemant Kumar Gupta, in 2011 booked four 2-BHK flats for Rs 2.08 crore. However, in 2012, the construction stopped, and despite demanding a refund, the builder refused to do so. 

The MIDC police probing the matter said that the builder is yet to produce valid documents, and upon further investigation, he will be arrested.

Mr Gupta said, “I had purchased four flats in the C-Wing of BBJ Sienna Vikhroli in 2011, and I was promised possession in 24 months. However, construction stopped in 2012 and hasn’t resumed nearly five years later. The builder’s intention in this matter is blatantly dishonest.

 Around 150 investors are stuck in the project which has three wings - A, B and C. The builders have also taken 100 per cent money from many investors, following which, the construction is still incomplete.”

Navinchandra Reddy, deputy commissioner of police (zone 10), said, “We are investigating and the arrest will be made as soon as the probe is complete.”
