Nine homebuyers denied possession since past 4 years

Mumbai: In yet another case, a group of nine homebuyers from Dombivali has been denied possession of their flats since the last four years. The homebuyers had booked the flats in Gurukrupa Enterprise, a residential project of “Gurukrupa Royale” between 2011 and 2012.

The construction works of the seven-storeyed residential buildings of the project remains incomplete since 2014, after civic officials stopped the work claiming the sanctioned plans as “illegal”. The developer had promised to handover the apartments by 2014 tentatively.

“I had paid Rs 19 lakh as booking amount for a 2BHK apartment purchased in the project and taken a loan amount of Rs 25 lakh for the same. Till date, I have been paying regular EMI to HDFC but haven’t got possession. The construction works have stopped since several years and the developer is also absconding from the past seven to eight months. We have approached the police and filed a complaint against him recently,” said Suresh Babu, an aggrieved homebuyer, who had purchased a flat on the fifth floor.

Three buildings, each of seven storeys, were planned under Gurukrupa Enterprise, of which, only one has been constructed up to seven storeys while the remaining two have been completed just till the fourth slab.

“We have received the complaint from homebuyers and the inquiry has started. Only after finishing the inquiry, we can decide on the action to be taken against the developer,” said a senior police official from Manpada police station.

“I had paid Rs 6 lakhs to the developer and he had promised to complete the construction, but since 2014, the work has been stopped. I sensed that something is wrong and demanded that my money be returned, to which he gave me three cheques in 2017 but all three bounced,” said Pragnesh Joshi, a homebuyer.

According to the landlord of the plot, the project was served a notice by the collector in 2014, due to illegalities carried out by the developer.
