Mumbai: The Bombay high court witnessed an emotional scene after a minor boy was united with his mother on the Bombay high court’s order on Tuesday. The scenes that unfolded saw the mother and the boy break down inconsolably, but both for different reasons. While the mother was emotional over getting her son’s custody, who was allegedly kidnapped by her estranged husband, the boy was crying as he was unhappy to leave his father who he had been staying with since past few months.

According to Advocate Raja Thakare who represented Ayesha Nakhuda, the mother, in the writ of habeas corpus in the court of Justices Ranjit More and Dr Shalini Phansalkar Joshi, seeking direction for to her former husband to appear before the court along with their six-year-old son, Ammar. “On August 8 last year, the father forcibly took the child, when he was returning home from school, and fled the city. The woman then lodged a kidnapping complaint against the boy’s father,” said Thakare.

Nakhuda and her husband Naeem Sayed were married in 2006 and Ammar was born in 2010. However, in 2014 the couple filed for divorce and Nakhuda was given custody of the child, as he was a minor. However, in August, Sayed allededly kidnapped Ammar and fled to Surat. Nakhuda filed an FIR against Sayed with MIDC police station. As the police could not trace Ammar, Nakhuda approached the high court. Sayed had meanwhile also applied for quashing the FIR but Justice A Oka had ordered him to produce the child following which he brought the child to court on Tuesday.
