CBI court allows Peter Mukerjea to stay in hospital
Former media baron Peter, who had undergone bypass surgery at Asian Heart Hospital, had sought six months interim bail on medical ground.
Mumbai: A special Central Bureau of Investigation (CBI) court on Thursday allowed Peter Mukerjea, an accused in 2012 Sheena Bora murder case, to take post-surgery rehab and care at Asian Heart Hospital at Bandra Kurla Complex (BKC).
Former media baron Peter, who had undergone bypass surgery at Asian Heart Hospital, had sought six months interim bail on medical ground. His lawyer had contended that he needed peaceful and hygienic condition to recuperate. It was further contended on his behalf that it takes time to heal post surgery and if he were sent to the state-run JJ Hospital or at the Arthur Road jail he would die of infection due to extremely unhygienic conditions there.
One of the contentions was that there was an inordinate delay in taking the accused to the JJ Hospital, because of inherent failure of government machinery. It is impossible for him to obtain timely medical treatment in time to save his life. It was apprehended that there was grave danger to his life, if he was sent back to jail, as no emergency treatment was available in Arthur Road jail.
However, the special CBI judge JC Jagdale had rejected his plea seeking interim bail on medical grounds. Meanwhile Peter's another application seeking regular bail on merits is also pending for order before the court. In the meantime his lawyer Amit Ghag filed another application before the court seeking permission to get his post surgery rehab treatment at Asian Heart Hospital where he has undergone the bypass surgery and the court has allowed this plea.
