Bombay High Court acquits trio from sodomy and kidnapping charges

Mumbai: The Bombay high court on Tuesday acquitted four persons from charges of sodomising and killing a three-and-half-year-old girl. According to prosecution the motive behind the crime was that minor’s father who is an owner of a medical shop had refused to give the accused drugs without doctor’s prescription.

Though, the prosecution produced a witness in the court and confession statement of an accused to support their claims, Bombay high court found gaps in prosecution’s argument and acquitted all the accused. The Bombay High set aside a trial court judgement that had convicted and sentenced the accused to life imprisonment.

The division bench headed by Justice V K Tahilramani observed that the witness who had seen the victim with the accused informed the minor’s father several days after the incident even though there was no reason for the delay.

The court did not accept the confessional statement of one of the accused, saying that he did not take any responsibility for crime and merely blamed the co-accused. The high court also rejected motive behind the murder.
