28-year-old gets life term for raping Class 1 child in 2014

Mumbai: A special POCSO court awards life sentence to a 28-year-old man for raping and inserting broom in private part of a class one child in 2014. The court observed that, “Rape is not merely an assault on the victim. It is often destructive of the whole personality of the victim. In case of murder, a person kills a human and the matter ends. The rape and molestation of the victim not only degrades the soul of the victim but it also causes serious psychological and physical harm.”
Taking stern notice of increasing incidents of rapes on minors the special POCSO Judge H.C. Shende of Dindoshi sessions court in her judgement sentencing Ali Mohammed Shaikh to life imprisonment further observed that, “Nowadays, children below 12 years become easy target of the assailants to fulfill their physical needs. The innocent children who really do not know anything about sex are becoming prey of such assailants. Homeless juveniles loitering on the footpath are always lifted by such persons and assaulted. Many a times those cases are not even reported.”
Public prosecutor Usha Jadhav with the help of witness’s statements including victim’s medical evidence and forensic reports proved the case of kidnapping, rape and other relevant sections of IPC and POCSO.
The prosecution case is that on August 20, 2014 the family was sleeping on the footpath and at around 6am when mother of the victim woke up she noticed that her daughter was not around.
She spotted her daughter crying on a nearby road. On reaching there, she saw her bleeding and her private parts were brutally assaulted. The victim was immediately rushed to a hospital where she was admitted for six months. The police traced the accused with the help of description given by the victim. On further investigation, it was revelaed that the accused was a resident of same locality in Kandivali.
