Order on bail plea of CPM leader's son on Monday
The letter and application (submitted to Mira Road police) mentions two different marriage dates.
Mumbai: While the Mumbai police is on a wild goose chase looking for Binoy Kodiyeri Balakrishnan, son of CPM leader Kodiyeri Balakrishnan, in connection with a rape case registered at Oshiwara, the Dindoshi court has reserved its order on the anticipatory bail application (ABA) till Monday. Meanwhile, an Oshiwara police team is camping in Kanur, Kerala to track down Binoy ahead of the order Monday.
The defence, Ashok Gupte, appeared before the Dindoshi court Friday stating that the case was baseless and that his client (accused in the case) had denied all allegations leveled against him.
“The woman has complained of my client promising marriage and fathering her child out of wedlock. However, the complainant had also sent Binoy a letter long before the case was filed, seeking alimony of '5 crore for marrying her and not keeping her after the baby was delivered. There is a contradiction in the claims made by the complainant,” argued advocate Gupte.
The legal counsel further stated that the woman had registered a complaint with the Mira Road police station before approaching the Oshiw-ara police and given a similar application there.
“The letter and application (submitted to Mira Road police) mentions two different marriage dates. She is now claiming
that the accused did not marry her and established physical relations, making her conceive a child. In that case, this is a case of marital dispute,” added advocate Gupte. The court will pass order Monday on the ABA based on arguments.
While the police is tight-lipped about the developments, the officials are using all ways and means to track down Binoy. There have been unconfirmed reports of a lookout notice being issued by the Mumbai police to step up vigilance at airports. The police meanwhile has served notice at the two residences of Binoy in Kerala while staying put there.
Meanwhile, the accused has managed to give the investigators the slip and switched off his mobile phone, making it difficult to track him.
