Pay Rs 4 Lakh for shaming journalist, Bombay HC tells Daman & Diu administration

The court based its decision on the basis of Constitution and earlier orders wherein handcuffing and parading in public was not allowed.

Mumbai: The Bombay High Court has awarded compensation of Rs 4 lakh to a petitioner who had complained of being subjected to unnecessary shame and ignominy by the administration of Daman and Diu by handcuffing him and parading him in public. The court based its decision on the basis of article 21 of the Constitution and earlier orders wherein handcuffing and parading in public was not allowed.

A division bench of Justices A.S. Oka and A.A. Sayed was hearing a petition filed by journalist Satish Sharma, who was arrested on the basis of a complaint filed by Mr Satyagopal, the administrator of Daman and Diu in 2009. The complaint was registered by the Diu police station under  Sections  384, 504 and 506 of the Indian Penal Code. Following the registration of an FIR, the petitioner had surrendered himself to the police and was taken to the Daman police station where he was “paraded in a handcuffed condition from Daman bus stand to Daman police station.”
