Hearing on Binoy's plea in rape case adjourned till Monday
Binoy Kodiyeri had filed the petition after a local court, on July 3, granted him pre-arrest bail in the case.
Mumbai: The Bombay high court Wednesday adjourned hearing on the petition filed by Binoy Kodiyeri till July 29. Binoy had approached the HC, seeking to quash the rape FIR filed against him by a former bar dancer.
“Binoy’s petition seeking quashing of the FIR filed against him was listed for hearing Wednesday, however the court has adjourned the hearing till Monday,” said Abbas Mukhtiar, the complainant’s lawyer.
According to advocate Mukhtiar, it appeared that the petitioner’s lawyer mentioned the petition before the court and sought an adjournment following which, the hearing was adjourned.
A division bench of Justice Ranjit More and Justice Bharati Dangre would now hear the petition on July 29.
Binoy had filed the petition after a local court, on July 3, granted him pre-arrest bail in the case. Following the court order, he moved the HC last week seeking to quash the case against him. According to him, he had been falsely implicated in the case.
The Sessions court, while granting bail to Binoy, had taken into consideration the contradictions mentioned in the complaint filed by the lady. The court however, had also directed Binoy to attend the police station every Monday and cooperate with the investigation and also give his blood samples to the police as and when asked so that a DNA test could be conducted to ascertain if he was the father of the complainant’s child.
A 33-year-old woman filed a rape case against Binoy on June 13, after she allegedly found out that the accused was already married. The woman, who is a native of Bihar, alleged that the accused exploited her for years together and later left her with their child. In her complaint, she claimed that they first met at a dance bar in Dubai in 2008.
