Singer's plea seeking compensation of Rs 15 lakh from docs rejected

According to her case she had approached cosmetic surgeon Vikas Sharma to get rid of the problems.

A consumer court in Thane rejected a professional singer's plea seeking Rs 15 lakh in compensation from two doctors for failing to eliminate dark circles under her eyes and fat on her abdomen and waist.

Mumbai: A consumer court in Thane rejected a professional singer’s plea seeking Rs 15 lakh in compensation from two doctors for failing to eliminate dark circles under her eyes and fat on her abdomen and waist. Rahima Gulam Azad, who claimed that she worked as an orchestra singer, said she had approached a cosmetic surgeon, on the recommendation of a dentist, to fix her problems.  She said that even after undergoing surgery in 2014 to remove the fat and scars, they reappeared after some time. The woman then underwent a follow-up, but even that didn’t help.

The complainant, a resident of Navi Mumbai,  had claimed before the Additional District Consumer Disputes Redressal Forum at Vashi that because of the scars and fat, she could not perform in orchestra events due to alleged deficiency in service on the part of doctor.

The consumer forum’s president V.K Shewale and members T.A Thool and G.M Kapse, in their order dated July 10, said Azad had no knowledge of medical jurisprudence.  

“Hence, her evidence about medical negligence by respondents in performing surgery for removal of dark circle under the eyes, liposuction and abdominoplasty can be said to be hearsay,” they observed in the order.

According to her case she had approached cosmetic surgeon Vikas Sharma to get rid of the problems. She said Mr Sharma performed surgeries on her in 2014 to remove that fat and scars but they appeared after some time due to alleged ‘medical negligence’ on part of the surgeon.

Hence, she sought a compensation of Rs 15 lakh from the two respondents, Dr Sharma and the dentist who had recommended this doctor, for the mental agony suffered by her and the medication and litigation costs.
