Continue with Aarey car shed at your own risk: Bombay HC to MMRCL
The petitioners were challenging the construction of the car shed in Aarey as the area was an ecologically sensitive forest.
Mumbai: The Bombay high court on Friday said that Mumbai Metro Rail Corporation Limited (MMRCL) could continue with its construction work of a car shed in Aarey Colony at its “own risk” because the matter was pending before the court.
A division bench comprising of Justice S. C. Dharmadhikari and Justice P. D. Naik warned the MMRCL while hearing a petition filed by two city residents, opposing the construction of the car shed in Aarey Colony. The petitioners were challenging the construction of the car shed in Aarey as the area was an ecologically sensitive forest and no such construction should be allowed here.
According to the petitioners, the state government has allegedly modified the draft Development Plan (DP) 2034 for Mumbai illegally, to show what was previously a green, no-development zone in Aarey Colony as a plot reserved for construction of the car shed for the Colaba-Bandra-Seepz metro line.
The MMRCL told the court in an affidavit filed earlier that the apprehensions of the residents and activists that the state was allowing the construction in Aarey Colony in contravention of the green norms, were unfounded.
