Bombay High Court approached again over Sohrabuddin case

In fresh trouble for BJP president Amit Shah, a social activist has approached Bombay high court requesting the court to either take suo moto cognisance of the order passed by the CBI court discharging Mr Shah from the Sohrabuddin Shaikh encounter case or direct the state of Maharashtra or CBI to challenge his discharge.

According to advocate Rekha Jain, petitioner Rahul Kadam, a member of NGO, Yash Foundation, has approached the court for the second time.

Earlier, the deceased Sohrabuddin’s brother, Rubabuddin, had challenged Mr Shah’s discharge in the Bombay high court, but later, he withdrew his application.

At that time too, Mr Kadam had filed an intervention application requesting the court to take suo moto cognisance of the matter and not allow Rubabuddin to withdraw his review petition because his decision appeared to have been taken under duress.

At that time, both Rubabuddin and Mr Shah’s lawyers had objected to the intervention application on grounds that he was not concerned with the matter in any way and hence, his application to intervene in the matter should be rejected. Justice Anuja Prabhudessai had also dismissed Mr Kadam’s application, observing that he was not an aggrieved party in the case and hence, had no “locus”.

Now, Mr Kadam has once again approached the high court, alleging that Mr Shah is misusing his powers because he is in the ruling party and investigating agencies are also working as per his instructions.
