CBI to take Chhota Rajan voice sample

The special court on Wednesday allowed CBI to take deported gangster Rajendra Nikalje alias Chhota Rajan’s voice sample for further investigation in the Jyotirmoy Dey murder case.

The application filed by the defence lawyers said the CBI should not take any self-incriminating statement of Rajan while taking his voice sample which could later be termed as his confessional statement.

The CBI had earlier requested the court seeking permission to conduct Rajan’s voice sample test to compare it with an intercepted telephonic conversation already available with the court.

In the meantime advocate Anshuman Sinha and advocate Avinash Kamkhedkar on behalf of Rajan also moved an application before special judge S.S. Adkar saying that the Mumbai police should clarify its stand whether it wants to hand over all the 68 cases registered in Maharashtra for further investigation to CBI or not.

According to advocate Kamkhedkar, they also requested the court to direct Mumbai crime branch to hand over a copy of the chargesheet and other documents of those cases which the investigating agency did not wish to hand over to CBI for further investigation.

During hearing, the usual CBI prosecutor of this case was not present in the court and when the judge sought to know why, another CBI lawyer informed the court that advocate Bharat Badami was busy with the Sheena Bora murder case and hence could not come to court.

The court however, asked the Mumbai crime branch to file reply on the application made by defence on whether they want to hand over any case registered against Rajan to CBI.

The court was informed that investigation was still on. The judge then adjourned the hearing.
