Mika Singh gets bail in molestation case

A sessions court in Dindoshi granted anticipatory bail to Bollywood playback singer Amrik Singh alias Mika Singh recently in a molestation case. Though the incident, wherein Singh was accused of having molested an upcoming model at his Versova residence, allegedly took place in August, the singer approached the court seeking relief from arrest only on October 14 and was granted bail on October 20.

The singer had to seek the anticipatory bail after the model filed the molestation complaint against him at the Versova police station in August, accusing the singer of having promised to get her modelling assignments and subsequently a film role. According to the complainant, the singer did not keep his promise and when she confronted him at his house, he molested her.

Following the complaint, the police had registered a case against Singh under Indian Penal Code sections related to assault or using criminal force against a woman with intent to outrage her modesty, voluntarily causing hurt, voluntarily causing hurt by dangerous weapons or means, intentional insult with intent to provoke breach of peace and criminal intimidation.

During the hearing of the anticipatory bail application, the court noted that as per the FIR, a common friend had introduced the complainant to Singh. The FIR said that about a month and a half prior to the incident, Singh had allegedly gone to the house of the complainant, and then held her hand and hugged her. When she said she would file a complaint, he allegedly promised to pay her money and requested her to not lodge the complaint.

As per the FIR, on July 5, the complainant visited Singh’s Versova house around 5.30 am and sought financial help. When Singh did not open the door of his house, she entered his house through a window. The model in her complaint has further alleged that at that time, Singh refused to pay her money and also abused and assaulted her apart from outraging her modesty by tearing her clothes. The model thereafter lodged the FIR with the police.

Singh’s lawyer, Falguni Brahamabhatt, told the judge, Dr C.A. Nathani, that the allegations against her client were “false” and the complaint itself said that the lady herself gained entry into Singh’s house through wrongful means.

The judge observed that the FIR revealed that the model entered Singh’s house via a window. The court said that the investigation is almost over and the police are expected to file the case chargesheet soon. According to the judge, the accused’s custodial interrogation was not required and the bail was therefore granted to him.

The judge also noted that the complainant had demanded Rs 5 lakh from the singer as financial help and, on his refusal, had lodged the complaint. “The matter seems to be mainly surrounding financial help. The nature of the allegation is such that custodial interrogation or investigation of the applicant is not required,” observed the judge before granting bail to Singh on a personal bond of Rs 15,000.

2015: He was accused of slapping a fan during his live concert in Delhi. Following the incident, an FIR was lodged against the singer, and the fan, who is a doctor, had even filed a Rs 50 lakh defamation suit against the singer. The complainant, however, later withdrew the case from a Delhi court after reaching an out-of-court settlement with the singer.
