New Delhi: Even as the Attorney General K.K. Venugopal presented a status report on the extradition of Vijay Mallya, the Supreme Court on Friday made it clear that it would pronounce the punishment after he was extradited and produced in the court.
A Bench of Justices A.K. Goel and Uday Lalit told the Attorney General that the court could not pass a sentence in absentia. “You produce him in the court and we will consider the punishment”, the Bench said. The AG said the UK court would take up the matter on December 4 and that all efforts are being taken for his extradition.
As per the status report presented in the court, the Centre said Mr Mallya would be lodged in the Arthur Road in Mumbai jail after his was extradited to India. It said “all evidence regarding falsities, mis-statements and false representations of Vijay Mallya and officials of his company were forwarded to the United Kingdom. The UK authorities are satisfied with material supplied by the Indian agency.”
The correspondence also said that one of the UK prosecutors had in a hearing acknowledged the “excellent cooperation from Indian authorities” and submitted that India had “sufficient material to establish a prima facie case.”
Taking note of the submissions of the AG, the bench deferred the hearing till Mallya was produced in the court on his extradition for award of punishment.
