SC to hear Centre plea on black money law today
New Delhi: The Supreme Court will hear on Tuesday the Centre’s plea against Delhi high court order holding that the provision of the Black Money Act could not be enforced prior to April 1, 2016 when the Black Money (Undisclosed Foreign Income and Assets) and Imposition of Tax Act, 2015 came into force.
The vacation bench of Justice Indira Banerjee and Justice Sanjiv Khanna agreed to hear the matter on Tuesday (May 21) when Solicitor General Tushar Mehta seeking an urgent hearing of the matter told the court that May 16, 2019, interim order by Delhi high court would have ramification on a number of ongoing cases.
The high court by its May 16 order had restrained the Centre and the Income Tax authorities from further proceeding against advocate Gautam Khaitan under the provisions of the Black Money (Undisclosed Foreign Income and Assets) and Imposition of Tax Act, 2015.
The high court’s interim order came in the wake of advocate Gautam Khaitan contesting the Centre’s notification advancing the enforcing of the Black Money Act to from July 1, 2015, instead of April 1.2016 when it was initially notified.
Khaitan had contended that the notification advancing the date of the Black Money Act coming into force to July 1, 2015 instead of April 1, 2016 was ultra vires.
It has been alleged that Khaitan, an accused in VVIP copter deal, had deposited a huge amount in overseas accounts.
The Centre in its plea before the top court has contended that Delhi high court has committed a “grave error of law.”
