The Supreme Court was moved on Saturday for a CBI probe into the brutal gangrape of a mother and her 13-year-old daughter on July 29 on the National Highway near Bulandshahar when they were traveling from Noida to Shajahanpur.

In a writ petition Kaushal Kishor, whose wife and daughter were gangraped, sought police protection and compensation. He also wanted the case to be shifted from a court in Uttar Pradesh to a court in Delhi to ensure a fair trial. He said the incident occurred near a by-pass road when six members of his family were traveling on NH 91 at around 1:30am to attend the death ceremony of a relative (grandmother).

Mr Kishor said he was an Ola cab driver by profession. When they were on their way, they heard a bang on the back of their car, but he did not stop the vehicle. The very next minute they again heard a bang and he stopped the car and stepped out to check what was the sound. Suddenly dacoits hiding behind the bushes emerged and took the family at gunpoint. They forced the petitioner to take the vehicle off the road. After which they were looted, beaten up, and tied up and then the dacoits dragged the 33-year-old woman and her minor daughter out of the car, took them to bushes and gang-raped both of them in front of the father and the husband (Kaushal Kishor).

The petitioner said the villagers of Dostpur told them that this is not the first time such an incident had happened. Crime has become rampant on this stretch as it is deserted with no street lights, locals say. The crime took place barely 100 meters from a police post but no one heard the sound. He faulted the police for not registering the FIR immediately.

In these circumstances, he apprehended that the victims might not get a fair trial in UP. To compound their agony, Azam Khan, Minister for Urban Development had called a press conference and publicly insulted the petitioner by terming the entire incident as a political conspiracy to defame the ruling government and thereby caused various acts and deeds being substantially outrageous to the modesty of the victims. Hence the present petition seeking judicial intervention, he added.
