While the Bihar government is planning to challenge the bail of Rocky Yadav — suspended JD(U) MLC Manorama Devi’s son, who is accused of shooting dead a Class-12 student for overtaking his car on May 7 — in the Supreme Court, serious doubts are being raised about the police investigation in the case.

Slain Aditya Sachdeva’s parents raised the issue of the police’s and the SIT’s laxity in the probe.

Principal additional advocate-general Lalit Kishore earlier said the “state government will file a petition in the SC to challenge Rocky’s bail”. The Opposition also raised the issue of serious lapses on part of the state government in the handling of the case. BJP leader Sushil Kumar Modi said, “Hardened criminals are getting bail from the high court as the state government doesn’t engage good lawyers to fight the case”.

Mr Modi had also pointed out that “Rocky Yadav was granted bail while his close associate Teni Yadav was still in jail. This aspect also raises doubts about how the prosecution is presenting the case in the court”.

Another important aspect of the case was the forensic lab report, which had established that the bullet which killed Sachdeva was fired from the pistol belonged to Rocky Yadav.

According to sources, the authorities had completely ignored vital clues during investigation. They said that the clothes of the victim were found strewn outside the postmortem room, from where they were later collected by Aditya’s parents.

Another important fact, which the prosecution didn’t present strongly in court, was Rocky Yadav’s father Bindi Yadav’s statement that his son may have fired in self-defence. His statement, legal experts said, also contradicts Rocky’s initial statement in which he had said that he was not present in Gaya when the incident had occurred.

“It seems that the prosecution didn’t present the case in the Patna high court strongly,” experts said in Patna when asked about their assessment regarding the state government’s role in the case.

Meanwhile, the Gaya police has stepped up the security for Aditya’s family after they approached the police seeking justice and security from Rocky Yadav who walked out of jail on Friday evening after being granted bail.

“Four police officials, including one assistant sub-inspector rank officer, have been asked to guard the family,” SSP Garima Malik said.

Reacting strongly to Rocky Yadav’s bail, Aditya’s mother Chand Sachdeva had slammed the state government and Bihar chief minister Nitish Kumar. “They had assured us that Aditya will get justice, but now, after bail was granted to Rocky Yadav, we feel that nothing has been done, and now I will not let any politician visit my house”.
