Kozhikode: Man ill-treats parents, loses land

Kasargod district collector P.S. Mohammed Sagir has ordered to retrieve the 1.80-acre land from accused K.M. Abraham as per the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The land at Palavayal village was given by Panathaanath Eliyamma, 70, to Abraham, her elder son, in 2012 on the condition that he would take care of her and husband Agasthy.

But in March 2015, the couple approached the appellate tribunal to cancel the deed alleging that their son was mistreating them. Revenue divisional officer (RDO) K. Jeevan Babu ordered Abraham to pay a monthly maintenance of '1,500 to each parent.

But dissatisfied with this, Eliyamma filed an appeal with the district collector, who is the appellate authority. She said that Abraham had ousted them from their home and that they were sheltered in a shed attached to the house. The Vellarikundu police had also registered a case against Abraham for thrashing his father.

The collector ordered to cancel the deed and give the land back to Eliyamma. “The 23 (1) clause of the act clearly states that the deed should be cancelled if children do not protect their parents,” said the collector.

Agasthi and Eliyamma are migrants from south Kerala and they had acquired over 20 acres of land through hard work. All the land except 1.80 acres was sold for the education and marriage needs of Abraham and their younger son, Joy.
