L-G office directed to compensate illegal arrest
New Delhi: A Delhi court has asked two police officials, the LG office, and the home ministry to compensate a man who was illegally detained and later arrested by the police.
The court noted that the victim, Rajesh Duggal, was wrongfully arrested by the cops for offence punishable under Section 107/151 (imminent danger to peace) of the CrPC.
Mr Duggal had moved a plea before the court seeking a compensation of Rs 5 lakh from the cops, LG office, home ministry, and one Rahman, alleging that they were behind his illegal arrest and detention.
The court gave relief to Rahman saying that there was no proof against him and his family to prove that they were hand in gloves with the cops and had hatched a conspiracy to get the victim arrested. “LG office, home ministry, and the two cops should pay the compensation to the victim. They should also pay him an interest of 6 per cent. The interest rate should be counted from the time of his arrest,” the court noted. According to the plea filed, a non-bailable warrant had been issued against Rahman in connection with a cheating case lodged by Mr Duggal’s relative.
