Delhi Court refuses to direct cops to act against legislator

The court observed from the status report filed by the police that the complaint emerged out of a dispute between the parties.

New Delhi: A Delhi court has taken cognisance of a complaint against Aam Aadmi Party (AAP) MLA Saurav Bhardwaj for alleged offences of extortion, criminal intimidation and defamation, but refused to direct the Delhi police from registering an FIR against the legislator.

Additional Chief Metropolitan Magistrate (ACMM) Samar Vishal said that it was not a case where some expert investigation was required to collect evidence and the complainant can produce corroborative evidence without police assistance.

He said: “I am of the view that the present complaint doesn’t require any field investigation by the police. The nature of offences stated in the complaint are personal to him and he has to prove the same. It isn’t a case where some expert investigation is required to collect evidence.”

Taking cognisance of the alleged offences, Mr Vishal said: “Whatever evidence is required, is mainly the complainant’s testimony along with some other corroborative evidence, which the complainant can produce in the court without police help. Further, the court is competent enough to inquire into the offence alleged in this case without police aid,” the ACMP said, while taking cognisance of the offences.”

The court observed from the status report filed by the police that the complaint emerged out of a dispute between the parties. In his complaint, S.S. Gupta told the court that he was manufacturing and selling mineral water in Kalkaji and had a valid licence for it.

The complaint alleged in September last, Mr Bhardwaj, an MLA from GK, along with the other accused, including the government senior secondary girls school  principal in Kalkaji, trespassed on his premises, harassed him and demanded money, threatening him that they would get the unit shut and implicate him in false cases.

“A visit to the complainant’s unit along with the principal by an MLA in view of the safety of schoolkids and to find out a solution for of obstacle in proposed emergency evacuation plan doesn’t come under purview of trespass,” the court said.
