Forensic evidence saves man accused of bid to kill wife
New Delhi: The Delhi police claim of having solved a blind case of attempt to murder has fallen flat in a court here, which said forensic evidence demolished the prosecution theory that the husband tried to kill his wife as she did not take his phone calls.
The court said the blood sample found on the shirt of the husband did not match with that of the wife.
Further, the prosecution case was demolished as the victim, during the trial of the case, had said she did not see the person who had attacked her from behind.
Special judge Rakesh Pandit, while noting that the wife herself denied involvement of her husband, said the prosecution failed to give plausible explanation about the presence of blood stain of “O” group on his shirt while the blood group of the victim appeared to be “B”.
The judgment said the forensic reports had suggested that, moreover, two types of blood groups were found.
“On the shirt of the accused, the blood group ‘O’ was found while on other exhibits blood group ‘B’ was found. From the perusal of the said report, it appears that the blood group of victim is ‘B’,” the report said.
The court found the unexplained mismatch of the blood groups vital, specially because the accused — southwest Delhi resident Ravi Kumar Singh — had stated that some unknown person had attacked his wife and in order to solve the blind case, he was falsely implicated in the case.
The judge also rejected the police claim that the man himself had informed them about the crime since the agency failed to prove before the court that the alleged mobile number belonged to the accused.
Another claim of the agency that one of couple’s neighbour, an eyewitness, had claimed that it was Singh who had assaulted her failed to impress the court after the witness denied the same before it.
