Fradulent' claim plea set aside by high court
New Delhi: The Delhi high court on Monday has sought a reply from the AAP government on the conduct of some Employees' Compensation Commissioners, setting aside an order to award a compensation of Rs 2.94 lakh to a truck driver on a claim petition filed by the worker.
The court said, “The claim petition is a complete fraud upon the appellant (Oriental Insurance Company) as also the provisions of the Employees’ Compensation Act.”
In his order, justice Valmiki J. Mehta directed directed that a copy of this judgment along with the judgment of the Employees’ Compensation Commissioner be sent to the law minister and the law secretary to show how certain Employees Compensation Commissioners allow undeserving claim petitions in order to defraud the insurance companies of their money.”
