New Delhi: A Delhi court has summoned AAP MLA  Akhilesh Pati Tripathi for allegedly obtaining money for the medical bills of his mother, though she is not a dependent. 

The metropolitan magistrate, Shefali Barnala Tandon, noted that prima facie Mr Tripathi had committed the offence punishable under Section 420 of the Indian Penal Code and summoned him for the same.

“With this background, complainant Vivek Garg has prima facie proved on record that an offence under Section 420 of the IPS has been committed by the accused. 

“Therefore, accused be summoned accordingly for filing of PF on the next date of hearing,” the court noted while fixing the matter for next hearing on February 2, 2018. 

BJP leader and RTI activist Vivek Garg, who filed the complaint against Mr Tripathi, alleged that an offence was committed by the MLA as he managed to reimburse his mot-her’s medical allowance running into lakhs of rupees from the Delhi government despite the fact that his parents were not dependent on him and not entitled for medical reimbursement.

The complainant said in his plea that Mr Tripathi, in his two affidavits filed before the Election Commission during the 2013 and 2015 Assembly elections, had declared that his parents were not dependent on him.

Mr Garg sought that an FIR be registered against Mr Tripathi — who is the MLA from Model Town constituency — for alleged offences of cheating, criminal breach of trust by public servant, forgery for cheating, and criminal conspiracy under the Indian Penal Code.

However, the court said that only the offence of cheating is made out against Mr Tripathi.
