Developer asked to be produced in court
Mumbai: The Bombay high court has restrained the family of developer Tejal Rupji from alienating, selling or creating third party rights of any property owned by the family while Rupji is in jail and has asked the superintendent of Arthur Road jail to present Rupji in court to get a commitment from him towards arranging for funds to complete work on a stranded project undertaken by him.
A bench of Justice S.J. Kathawala was hearing the commercial arbitration petition filed by Mulund Raviraj Cooperative Housing Society against Rupji for leaving them without a roof after the redevelopment project he undertook on the plot owned by the society was left incomplete due to lack of funds.
The society filed the petition after the Brihanmumbai Municipal Corporation said that it would take over the plot of land owned by the society to recover its dues of Rs 39 lakh which Rupji failed to pay.
Rupji’s counsel said that he was willing to arrange for funds by selling a property worth Rs 10 crore provided he was let out from jail. The HC refused to grant his condition and directed the Rupji family to provide a list of movable and immovable assets from which the stalled project could be restarted and dues paid off.
