Curative plea is the next step in Loya case?
Mumbai: With the Supreme Court on Tuesday dismissing a plea seeking a review and recall of its April 19 judgement that said that special CBI court judge BH Loya died a natural death and no investigation is required in his death, one of thes petitioner, ‘Bombay Lawyers Association’ (BLA) president has said that a remedy is still available which is to file curative petition.
Curative petition is the last resort of corrective measure which can be pleaded for in any judgement or decision passed by the Supreme Court.
“Yes, the review petition has been dismissed by the apex court. We will see the order. We will consider filing curative petition after going through the (SC) order,” said Ahmed Abdi, the president of BLA.
BLA had filed the petition on the basis of some news reports published two years after judge Loya’s death. The reports suggested that Loya’s death was not natural and hence BLA sought an enquiry into his death.
The petition had said, “The present petition is being filed seeking independent investigation into the circumstances surrounding the death of late judge Loya by a commission of enquiry headed by a retired Supreme Court judge constituted by the high court as a guardian of subordinate judiciary.”
