Dossa seeks action against Abu Salem

According to him Salem had also attacked him with two of his accomplices inside Arthur road jail in 2010.

Mumbai: Alleged gangster Mustafa Dossa, an associate of fugitive Mumbai underworld don Dawood Ibrahim, has approached the additional chief metropolitan magistrate requesting it to decide on his long-pending complaint against extradited gangster Abu Salem for attacking him inside Arthur road jail. The complaint pertains to an incident of July 2010, when Abu Salem had allegedly sustained injuries inflicted on him with a sharpened spoon by Dossa.

Initially, an FIR was lodged against Dossa and Qayyum in N.M. Joshi Marg Police Station but the case was transferred to Mumbai Crime Branch. Following this, Dossa had written to Bombay high court alleging that despite submitting a written complaint to N.M. Joshi Marg police, no action was taken. HC converted his complaint into a writ petition, which was later withdrawn by his lawyer Rizwan Merchant and another formal petition was filed seeking FIR against Salem.

The high court had allowed Dossa to withdraw his petition with liberty to file a private complaint against Salem, following which Dossa filed the same in 37th Metropolitan Magistrate Court in 2011, but this application is still to be decided by the court.

Advocate Merchant on Saturday argued before the magistrate R.K. Deshpande that although the incident occurred in Arthur Road Jail, which does not fall under jurisdiction of this court, since crime branch is probing the case the court has jurisdiction to decide on 0Dossa’s complaint. The matter has now been deferred till June for further hearing.

According to him Salem had also attacked him with two of his accomplices inside Arthur road jail in 2010. Dossa through his lawyers Rizwan Merchant and Sultan has contended that since there was a cross complaint against him and Salem and crime branch is already investigating this matter on Salem’s complaint the same agency should also carry out investigation in respect of complaint made by him.
