No HC relief for girl awaiting OBC certificate

HC observed that she was fully aware that she was taking admission on a reserved seat.

Mumbai: The Bombay high court (HC) refused to give relief to a student, whose caste validity is pending before the caste scrutiny committee. According to the petition, the scrutiny committee has not taken a decision on verifying her caste for seven years, in which time the girl has completed her B.Tech. Further, the Mumbai University (MU) has not issued her the original mark sheet and certificate as the caste scrutiny committee has not given its order. The petitioner belonging to the other backward caste (OBC), claimed that despite two orders and directions of the high court, her claim is still pending before the committee.

The court noted that it is neither the girl’s fault that her caste certificate is pending before the scrutiny committee, nor the university’s fault in withholding her original documents and marksheets. HC said that the girl should have complied with the preconditions and prerequisites of the admission process. HC observed that she was fully aware that she was taking admission on a reserved seat.
