Mumbai: A sessions court in Dindoshi has convicted and sentenced life imprisonment to two accused in connection with the murder of a man whose body was found dumped in a suitcase at Malvani, Malad in 2013.

The accused men, including the son-in-law of the deceased Alam Ansari, had killed the latter because the deceased had usurped an amount of  Rs 16,000 that was meant for the bail of the accused duo because they were behind bars in a chain-snatching case.

The prosecution case was that on October 6, 2013 body of a man was found in a bag at Dumping road in Evershine Nagar in Malad (W). The police found out that the body was of Alam Ansari (33).

The police had claimed that both the minor sons - aged 12 years and seven years  of accused Khan were eye-witnesses of the murder and their statements under section 164 of CrPC were recorded that can be used as evidence in the court of law.

However, during trial the court was informed that both the minor sons were untraceable and hence they could not be called as witnesses.

Sessions judge D.K. Bhende took note of this fact that accused Khan didn't give satisfactory answer about missing of his sons who were eyewitnesses to the incident.

He told the court that he is in jail and is not aware about how they have gone missing. However, the judge noted that even mother of children didn't lodge missing complaint about their sons.

The prosecution called ten witnesses and by circumstantial, scientific evidence and last seen together theory proved the case against the accused.  

The prosecution proved that indeed the accused facing trial committed murder. The judge awarded life sentence to both the convicts.
