Woman with Mustafa Dossa in train not wife: CBI
Mumbai: The CBI on Monday informed the TADA court that the woman who had travelled with Mustafa Dossa in train, while Dossa was being taken to Porbundar in Gujarat in December 2016, is not Dossa’s wife, and the police officer who allowed this lady to travel with Dossa will be prosecuted under relevant sections of IPC.
Special public prosecutor Deepak Salvi informed special TADA court judge GA Sanap that the inquiry report has said that the statement of Shabina Khatri, who was claimed to be Dossa’s wife, was recorded and she stated that she did not sign the Nikah Nama produced to prove that she was married to Dossa. She claimed her signature was forged on the Nikah Nama.
Salvi further told the court the inquiry panel had also spoken to an expert of Shariah law who said that the Nikah Nama did not have requisite details and hence this marriage cannot be recognised as valid.
Salvi however, informed judge Sanap that the inquiry against assistant police inspector Ayaz Patel, who was heading the escort party and had allowed the lady to travel in train with Dossa, is going on and he would be prosecuted under various sections of IPC for dereliction of duty and also endangering life or personal safety of others. The court was informed that Khatri would also be prosecuted for charges like cheating by personating and cheating etc. Dossa, a convict in the 1993 serial bomb blasts case died before pronouncement of quantum of punishment.
