Plea seeks 7-judge bench to hear Loya death case

The petitioner said that judge Loya had stayed at government guesthouse Ravi Bhavan at Nagpur.

Mumbai: An activist has approached the Bombay high court seeking the constitution of a seven-judge bench to hear a petition regarding the death of judge Brijgopal Hark-ishan Loya in suspicious circumstances.

The petitioner claimed that certain important facts were suppressed from the Supreme Court in this regard and hence the apex court disposed of the petition on the basis of material on record.

The petitioner requested to the court in order to treat this petition as FIR and form a special investigation team (SIT) and investigate this matter through 3 IPS officers and bring on record facts that were suppressed from the court in the past.

Advocate Nitin Satpute on behalf of Sanjay Bhalerao filed a petition contending that some important facts were not put before the apex court such as it was not revealed that judge Loya had gone to Nagpur on an official trip not especially to attend some marriage.

The petitioner said that judge Loya had stayed at government guesthouse Ravi Bhavan at Nagpur.

The petitioner requested the court to direct the commissioner of police, Mumbai, and Shahu Nagar police station in Mumbai to collect the record of departure of Loya from Mumbai to Nagpur and every detail of his visit, and to check if all the protocol was followed during his visit.

According to the petitioner if the protocol had been followed, judge Loya should not had been taken to hospital in a local rickshaw.

The petition stated that rigor mortis was found in judge Loya’s body during the post-mortem and rigor mortis is not developed in dead bodies in a short period of time.

The petitioner also stated that at the time of his death, Loya was conducting trial in 2005 Sohrabuddin Sheikh fake encounter case in which BJP president Amit Shah was an accused.

The petitioner pointed out that around a month after the death of Loya the court discharged Mr Shah from the case.

The petitioner and his lawyers have sought round the clock police protection pending the hearing of this petition.
