Court keeps Chhagan Bhujbal's bail order on hold

Mumbai: The special PMLA court on Friday reserved its order on former deputy chief minister of Maharashtra Chhagan Bhujbal ’s bail application till December 18. Bhujbal is behind bars in connection with the money launder case.

Bhujbal through his lawyer Shalabh Saxena filed a bail application contending that he has been falsely implicated in the case. The NCP leader is also relying on a recent Supreme Court order in which the court has struck down section 45 of PML Act that creates hurdle in granting bail. According to Bhujbal’s lawyers since this section is removed this bail should be treated as a normal bail application and since he is in jail since almost two years he should be granted bail.

The Enforcement Directorate (ED) counsel Hiten Venegaonkar has opposed Bhujbal’s bail plea saying even thought the Apex Court has removed one section, the court should take into consideration other parameters into consideration while deciding bail. Mr Venegaonkar said that section 24 puts burden of proof on accused so bail application should be rejected.
