Arrested accused Shahrukh Gulam-nabi called and threatened actor Salman Khan’s PA and father.

Talking about the grounds on which the bail has been filed advocate Awasthi said, “The first and foremost ground is that section 170 of the IPC and 66 (D) of the IT Act are not applicable because there is no ingredient in the complaint to invoke these sections.” (Representational image)

Mumbai: Shahrukh Gulamnabi alias Shera, who was arrested from Uttar Pradesh for allegedly making threatening phone calls to Bollywood star Salman Khan’s personal assistant (PA) seeking the actor’s contact number, has filed a bail application in the sessions court.

“We have moved the bail application on behalf of Shahrukh and this application would be heard in due course,” said Gulamnabi’s lawyer Anjali Awasthi.

The Bandra police arrested Shahrukh under sections 170 (Impersonating a public servant) and 506 (II) (Criminal intimidation) of the Indian Penal Code (IPC) and 66 (D) of the Information Technology (IT) Act.

Talking about the grounds on which the bail has been filed advocate Awasthi said, “The first and foremost ground is that section 170 of the IPC and 66 (D) of the IT Act are not applicable because there is no ingredient in the complaint to invoke these sections.”

According to advocate Awasthi, the applicant did not impersonate any public servant, and only because the call received by the actor’s father, Salim Khan, showed ‘DGP (Director General of Police)’ on the Truecaller app it cannot be called impersonation. “In the complaint, he never said that it was the DGP or any other officer,” she said.

According to police, Gulamnabi was arrested from Prayagraj, Uttar Pradesh, after it received a complaint by Salman’s PA that a man made threatening calls to Salim Khan asking him to share actor’s contact number.

According to the complaint, Shera first called the actor’s PA Nibhas Chayya on October 6, threatened to kill Chhaya and asked for Salman’s personal number. However, Chhaya refused to give Salman’s number, upon which he threatened to kill him. After a gap of few days, on October 13, Salim Khan received a call from Shera.

The police then began analysing the technical data of the calls and located Gulamnabi in UP.

The police have claimed that Gulamnabi has a criminal record and he wanted to work with Salman. Gulamnabi has cases like attempt to murder and those under the Arms Act registered with the UP police.
