Court rejects bail to restaurant managers

Mumbai: A magistrate court in Bhoiwada, Dadar on Thursday rejected the bail applications filed by Kevin Bawa (34) and Lisbon Lopez (34), the managers of 1 Above, where 14 people were found dead after a fire broke out there and Mojo’s Bistro on December 29.

Advocate Vijay Thakur on behalf of both the managers argued before magistrate V.B. Bohra that section 304 (culpable homicide not amounting to murder) of IPC was not applicable on this case and hence they should be granted bail. Mr Thakur also argued that the applicants should have been eyewitnesses of the case and not the accused.

Public prosecutor Sanjay Wadhavane, however, opposed the bail plea. After hearing the arguments, magistrate Bohra rejected the bail application, saying the offence is serious and triable in the sessions court.
