Bombay High Court seeks report on BRIMSTOWAD

Mumbai: The Bombay high court has directed the Brihanmumbai Municipal Corporation not to allot any of the buildings meant for Brihanmumbai storm water disposal system (BRIMSTOWAD) project affected persons (PAP) to any other project affected persons without obtaining the high court’s permission.

The division bench of the Chief Justice Manjula Chellur and Justice M.S. Sonak issued this direction while hearing public interest litigation (PIL) filed by one Bhavna Shah. The petitioner filed the petition stating that the BRIMSTOWAD is not implemented so far and the buildings put up at Mahul for project affected persons of BRIMSTOWAD project would be given to other project affected persons which will further delay this project.

The court has also sought details of the progress made till date in the project. “We direct the corporation as well as the respondent authorities, to place on record the progress made till date in respect of the project, whether it is still a paper proposal or some implementation is done,” said Justice Chellur.

The bench also said, “Further apprehension of the petitioner seems to be that buildings put up at Mahul meant for the rehabilitation of the persons under BRIMSTOWAD may be allotted to other project affected persons, leading to further delay in the BRIMSTOWAD project.”

The bench added, “We direct the respondent – corporation not to allot any of the buildings put up at Mahul for the purpose of BRIMSTOWAD project affected persons to any other project affected persons, without obtaining leave of the court.”

The court will hear this petition again after four weeks.
