CBI to move to SC for Sheena Bora murder case

Patil said that after receiving the copy, the CBI would decide whether to challenge the order in the SC or not.

Mumbai: The CBI has informed the CBI court on Monday that it is considering approaching the SC in the Sheena Bora murder case to challenge the HC’s order, which said that the police officer, who interrogated the accused-turned-approver Shyamvar Rai, was not an independent witness.

Special public prosecutor, Kavita Patil requested special judge J. C. Jagdale to defer hearing saying the CBI is yet to get the certified copy of the high court order.

Ms Patil said that after receiving the copy, the CBI would decide whether to challenge the order in the SC or not.

Sub-inspector Ganesh Dalvi could not complete his testimony because the defence raised an objection that Dalvi should not be allowed to tell the court what Rai had told him about the murder case during his interrogation in an arms case. The CBI court had rejected the defence application, following which accused Peter and Indrani had challenged the order in HC which held officer's evidence inadmissible.
