Court rejects GRP constable’s anticipatory bail plea

Mumbai: A Sessions court rejected the anticipatory bail application of a GRP constable who had allegedly taken away Rs 4,000 and digital camera of a complainant after he along with his friend were caught travelling in a compartment reserved for handicap passengers in a local train. The complainants are based in Delhi and had sent their complaint via email after reaching Delhi.

Sessions judge D.S. Deshmukh rejected the pre-arrest bail plea filed by Santosh Vajarakar (52) booked for extortion.

Public prosecutor V.S. Tawade had contended before the court that on June 30, complainant Deepak alias Ashotosh Dixit, a resident of New Delhi, and his friend Atul was travelling from Churchgate to Santacruz in a slow local train. Both were travelling in a boggy reserved for physically challenged passengers and when the train reached Santacruz, Vajarakar caught both of them for travelling in a boggy where general passengers are not allowed to board. He took both the persons to a room where the applicant and co-accused took away Rs 4000 cash and a digital camera before releasing the duo.

After reaching Delhi, Mr Dixit complained to railway authorities via email a FIR was registered based on this.

 The judge observed that without producing them before the competent authority of railway, they were taken in the room where their cash and digital camera were taken away. “This conduct of the applicant shows dishonest intention for committing the offence,” observed judge Deshmukh.
