Mumbai: The Bombay high court has directed the Director General of civil aviation (DGCA) to take action against 45 buildings which have violated height regulation norms during construction near to the domestic and international airports in the city. The court has directed DGCA to complete the demolition process against violated buildings within three months.  

DGCA counsel Rajiv Chavan has submitted a list of building and confirmed that out of the 137 buildings, 45 have violated the height regulation norms.  The court has directed DGCA to take action against these structures.

A division bench of Justice V.M. Kanade and Justice M.S. Sonak was hearing the petition filed by Advocate Yashwant Shenoy who sought action against those building which have violated the height norms, becoming a threat to the path of the flights.

Petition alleged that AAI has given illegal height clearance for around hundred of buildings in violation of their own regulations.

During the last hearing, the court had rapped DGCA and directed to look in to the issue very seriously and told to remove structures which are creating obstacle in the flight path.

Court on Wednesday expressed satisfaction on the survey done by DGCA. The court also directed civil aviation ministry to consider the issue and take action.

The Court also asked MIAL that explain criteria of measuring heights for NOC on next hearing.

Petitioner Shenoy informed the court that there are around 20 buildings in which construction is going on had also violated the height norms.

He also told that people from ATC have filed complaints against it to the BMC but the BMC has not taken any action against them.

The court then asked BMC to file an affidavit about what they have done so far against those complaints.
